Welcome to Ludoria. By accessing or using our platform (available at https://ludoria.app, and the Ludoria mobile application), you agree to these Terms of Service ("Terms") in their entirety. If you do not agree with any of these Terms, you must not use the Platform.

Ludoria is a social platform for gamers focused on LATAM, offering game tracking, reviews, ratings, personalized lists, and community participation.

These Terms constitute a binding agreement between you ("Resident" — the term Ludoria uses to refer to its users) and the individual operator of Ludoria, based in Mexico.

4.1 Ownership of content

You retain ownership of all original content you post on Ludoria, including reviews, text, profile images, and lists ("Resident Content").

4.2 License granted to Ludoria

By posting Resident Content on the Platform, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, modify, and create derivative works from such content solely for the purpose of operating, improving, and promoting the Platform.

This license terminates when you remove your content from the Platform, except where the content has been shared by other residents or is necessary for the operation of the service.

4.3 Content responsibility

You are solely responsible for the Resident Content you post. Ludoria is not liable for content posted by residents, although we reserve the right to remove it if it violates these Terms.

4.4 Third-party content

Video game information (cover art, metadata, descriptions) is sourced from the IGDB/Twitch API. Opinions expressed in resident reviews belong to each author and do not represent Ludoria's position. Ludoria is not affiliated with Sony, Microsoft, Nintendo, or any other game developer or publisher.

5. Moderation and Compliance

5.1 Content moderation

Ludoria reserves the right to review, edit, move, reject, or remove any Resident Content that, in our reasonable discretion, violates these Terms, is harmful to the community, or is contrary to law.

5.2 Content reports

Residents may report content they consider inappropriate using the tools available on the Platform. We will review reports within a reasonable timeframe and take actions we deem appropriate.

Depending on the severity and frequency of violations, consequences may include:

6.1 Ludoria ownership

The Platform, including its design, code, logos, name, visual identity, features, and all content generated by Ludoria (excluding User Content and IGDB catalog content), is the exclusive property of the operator of Ludoria and is protected by applicable intellectual property laws.

6.2 Restrictions

You may not copy, modify, distribute, sell, rent, reverse engineer, or create derivative works from the Platform or its content without Ludoria's express written authorization.

6.3 Third-party trademarks

The names, logos, and trademarks of games, gaming platforms, and other third parties mentioned on Ludoria are the property of their respective owners. The appearance of such marks does not imply affiliation or endorsement.

6.4 Copyright infringement notices

If you believe your copyrighted work has been reproduced on Ludoria in a way that constitutes infringement, contact us at ludoria.online@gmail.com with detailed information about the alleged infringement.

7. Linked Accounts and External Services

Ludoria may allow you to link external platform accounts (Xbox, PlayStation, Steam, Discord, Spotify, among others). By doing so:

Ludoria may in the future offer paid subscription plans with additional features.

8.1 Pricing and billing

Subscription prices will be clearly disclosed before completing any purchase. By subscribing to a paid plan, you authorize Ludoria to charge the corresponding amount on a recurring basis according to the selected billing cycle.

8.2 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation will take effect at the end of the current billing period.

8.3 Refunds

Unless applicable law provides otherwise, subscription payments are non-refundable. Upon cancellation, you may continue to enjoy the paid plan until the end of the current period.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

Nothing in these Terms excludes or limits Ludoria's liability for death or personal injury caused by gross negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

You agree to indemnify, defend, and hold harmless Ludoria and its representatives from any claim, loss, damage, liability, and expense (including reasonable legal fees) arising from:

We may suspend or terminate your access to the Platform, with or without prior notice, if:

Upon termination, your access to the Platform will cease. Terms that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will remain in effect.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Mexican States. Any dispute related to these Terms or use of the Platform shall be submitted to the competent courts of Mexico.

In the event of a dispute, we invite you to contact us first at ludoria.online@gmail.com to attempt to resolve it amicably before resorting to legal proceedings.

13. Modifications to the Terms

We may modify these Terms at any time. We will notify you of material changes through a notice on the Platform and/or by email at least 15 days in advance.

Continued use of the Platform after the changes take effect constitutes your acceptance of the updated Terms.
